Terms of Use
These terms apply when you search, send a booking request or an inquiry, or create an account on Travel to Montenegro Booking (traveltomontenegro.com/booking). Please read them together with the Privacy Policy and the Cancellation Policy.
This page is a working draft that has not yet been reviewed by a lawyer. Highlighted values in brackets are still missing and will be completed by the operator. If anything is unclear, contact us before you book.
1. Who we are and what we do
The platform is operated by [NAZIV PRAVNOG LICA], [PRAVNA FORMA, npr. d.o.o.], [ADRESA SJEDIŠTA], registration no. [REGISTARSKI BROJ (CRPS)], tax ID (PIB) [PIB] ("we", "the platform"). Full company details are in the Legal notice.
We run an online marketplace that connects travellers with local providers in Montenegro ("hosts"): accommodation, rent-a-car agencies, transfer companies and other tourism services. We are not the provider of the accommodation, vehicle or service. The contract for the stay, rental or transfer is concluded directly between you and the host once the host confirms your request.
2. How booking requests work
Listings are shown either with a price ("booking request") or as "on request" ("inquiry").
When you send a booking request, you choose dates and the number of guests, and we show you a price breakdown calculated by our server from the host's current prices. Your request is not yet a confirmed booking: the host checks availability and confirms or declines it. You will see the status under My bookings. A booking is binding only after the host has confirmed it.
An inquiry is a message to the host without a price or booking. The host replies with an offer directly to the contact details you provided.
- Please make sure your name, e-mail and phone number are correct — the host uses them to contact you.
- Do not send a request unless you intend to travel on those dates.
- We never confirm a booking on the host's behalf and we do not promise instant confirmation.
3. Prices, fees and taxes
Prices are set by the host and shown in euros. The total shown before you send a request includes the price of the stay or service, any extra-guest and cleaning fees set by the host, and a platform service fee of 5% of the price of the stay or service (without cleaning and extra-guest fees).
Tourist tax (boravišna taksa) is a local municipal tax charged per person per night. Unless a listing states otherwise, it is not included in the total and is paid on site to the host, who pays it to the municipality. Amounts and exemptions are explained in the Help centre.
A security deposit (for example for a rental car) is shown on the listing when the host requires one. It is handled directly by the host (cash or a card hold) and returned according to the host's conditions.
4. Payment on site
At present nothing is charged online through the platform. You pay the host on arrival, pick-up or at the start of the service, using the payment methods the host accepts. The host issues you a fiscal receipt as required by Montenegrin law.
If we introduce online payment in the future, we will update these terms and clearly show before you book what is paid online and what is paid on site.
5. Cancellation and changes
You can cancel a request that the host has not yet confirmed at any time, free of charge. After confirmation, the cancellation policy of the listing applies (Flexible, Moderate, Strict or Non-refundable) — see the Cancellation Policy. If a listing does not show a policy, the conditions you agree with the host apply.
No right of withdrawal. Accommodation, car rental, transport and leisure services booked for a specific date or period are excluded from the 14-day right of withdrawal for distance contracts (Article 16(l) of EU Directive 2011/83/EU and the corresponding provision of the Montenegrin Consumer Protection Law). Your cancellation rights are those in the listing's cancellation policy.
6. Hosts' responsibilities
Hosts are responsible for the accuracy of their listings (description, photos, prices, availability), for holding the licences and categorisation required by law, for registering guests with the authorities, for collecting and paying tourist tax, for issuing fiscal receipts and for providing the stay or service as described.
Where a host acts as a private individual and not as a trader, EU consumer protection rules may not apply to your contract with that host. When hosts register, they tell us whether they act as a private individual, a sole proprietor, a company or an agency; you can ask us for this information about any listing before you book.
7. Your responsibilities as a guest
- Provide accurate personal data and a valid identity document on arrival (required for guest registration).
- Respect the house rules, the maximum number of guests and the rental conditions (driver's age, licence, deposit) stated on the listing.
- Use the platform only for genuine travel purposes; do not post unlawful, misleading or offensive content.
8. Our liability
We are responsible for operating the platform with due care: correctly showing the information hosts provide, forwarding your request to the host and protecting your data. We are not a party to the contract between you and the host and are not liable for the host's performance of that contract, except where the law says otherwise or where we have acted with intent or gross negligence.
Nothing in these terms limits rights that you have as a consumer under mandatory law.
9. Reviews
Only guests with a completed stay or service booked through the platform can leave a review. See the Reviews Policy.
10. Accounts
You can browse without an account. To send a booking request or manage bookings, you need an account. Keep your password secret. You can ask us to delete your account at any time (see the Privacy Policy).
11. Complaints and disputes
If something goes wrong, first contact the host, then us at [email protected]. We will try to help you reach a solution. Consumers resident in the EU can also use the out-of-court dispute resolution bodies of their country.
These terms are governed by the law of Montenegro. Disputes are decided by [NADLEŽNI SUD], without prejudice to mandatory rules that allow consumers to sue in their country of residence.
12. Changes to these terms
We may update these terms. The version valid on the day you send a request applies to that request. The date of the last update is shown at the top of this page.
